Setup clearly depicted on chart, and valid assuming the next bar either closes without touching the current 5 bar downtrend mode, or expands range to the sell stop level. Further oscillation sideways here for a few days here would just mean wait until price detaches from mode or expands range lower to fulfill setup. If price closes above the earnings level, we are no longer interested in being short until below it once more.
